I.- UN SIGNO DE CLEMENCIA
Como ciudadanos y pastores queremos comprometernos con los esfuerzos de nuestro país por la paz: tanto por la paz que se abre espacio en nuestros corazones, como por aquella que anhelamos para las familias y todos los habitantes de nuestra Patria. Sabemos que la paz es obra de la justicia, pero estamos convencidos que también contribuyen a ella el perdón y la misericordia.

Al presentar esta petición, no ha sido nuestro ánimo poner al Gobierno de Chile, ni al actual ni al anterior, en una situación de incomodidad ante la realidad de las personas recluidas y de las víctimas. El contexto de una sana laicidad reconoce las competencias propias del Estado y aquellas de las confesiones religiosas.
Por esta razón, sólo presentamos algunas ideas que pueden enriquecer el espíritu y la práctica de nuestra convivencia y hacemos una petición, pero sin proponer un articulado de ley, tarea que corresponde a la autoridad política. Anhelamos que estas reflexiones sean discutidas por los ciudadanos y por nuestras instituciones, y que cada una asuma la responsabilidad que le corresponde.
En lo que se refiere a quienes están privados de libertad, dentro del respeto a la Constitución y a los Tratados Internacionales suscritos por Chile, solicitamos a las autoridades del Estado, en particular al Señor Presidente de la República y al Gobierno que preside, así como a los Honorables miembros del Parlamento,

Considerar y estudiar las siguientes proposiciones:
1. Que los condenados por sentencia ejecutoriada –con las restricciones que la autoridad competente considere prudente establecer como, por ejemplo, delitos de sangre-, que en los últimos años hayan tenidobuena conducta en los recintos carcelarios, y no constituyen un peligro para la sociedad:
a. Puedan ver reducidas parcialmente sus penas privativas o restrictivas de libertad.
b. Además de lo señalado, que se conceda una reducción adicional a quienes tengan más de 70 años de
edad.
c. Igualmente, que a las mujeres que tengan uno o más hijos menores de 18 años se les conceda también una reducción adicional.
d. Que a las personas condenadas privadas de libertad que padezcan alguna enfermedad invalidante, grave e irrecuperable, se les conmute su pena por otra, que no deba cumplir en las condiciones más aflictivas de
la cárcel.
e. Que a los enfermos terminales, debidamente comprobados por la instancia competente, se les condone el saldo de las penas que les resten por cumplir.
2. Que se mejoren sustancialmente las condiciones de vida de quienes cumplen penas privativas o restrictivas de libertad, aumentando las horas de convivencia fuera de sus celdas, favoreciendo el trabajo remunerado y el acceso a la enseñanza, el deporte, la cultura, y al auxilio espiritual. A pesar de los esfuerzos realizados en diversos gobiernos anteriores, no se ha logrado satisfacer estas necesidades, requiriéndose hacia adelante decisiones urgentes que la autoridad competente debiera ir adoptando por el bien común de la sociedad. Asimismo, considerando las especialmente difíciles circunstancias del ambiente laboral en que se desempeñan, y en el contexto del conjunto de los funcionarios públicos, que se mejoren
las condiciones de vida, de convivencia y de trabajo de los gendarmes y empleados por el sistema penitenciario; éstas irían en directo beneficio de la dignidad y rehabilitación de los privados de libertad.
3. Que se modifique la legislación que se refiere a las penas, en lo que atañe a los condenados de edad muy avanzada y a quienes estén gravemente aquejados de una enfermedad terminal. Proponemos que se les condone la pena o que puedan cumplir el resto de su condena junto a su familia o en instituciones asistenciales. Este cambio o condonación de la pena se concedería siempre, salvo que el organismo competente excluya este beneficio para un reo determinado por juzgarlo un peligro para la sociedad.
4. No sería completa la “mesa para todos” si no considerásemos en esta petición a quienes cumplen penas por delitos contra los derechos humanos cometidos durante el Régimen Militar. Es un tema que debemos poner sobre la “mesa de todos” para conversarlo con laseriedad que corresponde, especialmente en el Parlamento de la República. No olvidemos que no todos ellos tuvieron igual responsabilidad en los crímenes que se cometieron. A nuestro parecer no cabe ni un indulto generalizado ni un rechazo general del indulto para todo ex uniformado condenado. La reflexión debe distinguir, por ejemplo, el grado de responsabilidad
que le cupo a cada uno, el grado de libertad con que actuó, los gestos de humanidad que tuvo y el arrepentimiento que ha manifestado por sus delitos.
IV- EN EL CAMINO DEL EVANGELIO: JUSTICIA Y CLEMENCIA
No somos nosotros quienes debemos dictar las leyes, pero creemos que podemos interceder para dar paso a la “justicia con clemencia” como connotados juristas lo han pedido en el pasado. Es decir, velando por elimperio de la justicia -nada más injusto que la impunidad- y salvaguardando el pleno imperio de los derechos humanos en materia de crímenes de lesa humanidad, creemos que se pueden dar pasos de clemencia.
Sabemos que estas peticiones tendrán opiniones encontradas. Las respetamos, especialmente cuando vienen de personas que sufrieron en carne propia o en sus familiares más cercanos los delitos condenados.
Sólo solicitamos dar el paso de pedir justicia sin ensañarnos en el castigo, que nunca puede reparar totalmente el mal causado. Y solicitamos también, hablando al corazón de cada uno, que consideremos de qué manera quisiéramos ser tratados si estuviéramos en la situación de los condenados, y con qué espíritu fraterno podremos construir el futuro de Chile si no somos capaces de hacer gestos decisivos de reencuentro y reconciliación.
Más allá de los ordenamientos jurídicos y de sus interpretaciones, el mismo Jesús nos enseñó con su testimonio y su palabra, que la lógica del perdón es la única que restaña las heridas, devuelve la confianza e inaugura tiempos nuevos para quienes tienen la valentía de concederlo y de pedirlo. Nos conmueve el solo hecho de pensar que Jesús clavado en la cruz de la injusticia, antes de morir, pide al Padre que perdone a quienes lo han crucificado.
Ésa es la lógica y la pedagogía que anhelamos para cada uno de nosotros y la gracia que pedimos por intercesión de la Virgen del Carmen, Madre de todos los chilenos y chilenas, sin excepción alguna, pero especialmente de aquellos que por diversas causas atraviesan horas de angustia y de dolor.

ADOPTING A CODE OF PROFESSIONAL ETHICS

FOR SOCIAL WORKERS IN COLOMBIA



The National Social Work Council, exercising its powers under Law 53/1977, Decree 2833/1981, and



WHEREAS



1. Following Article 8 of Law 53/1977, it is the duty of the National Social Work Council to process denunciations received of breaches of professional ethics, and to sanction them.

2. The IV General Assembly of the delegates of FECTS, a member of the National Social Work Council, adopted the Code of Professional Ethics for Social Workers, in Barranquilla, Colombia on March 27, 1981.

3. The National Social Work Council was inaugurated on July 16,1986.

4. Scientific and technological advances, and today's social realities require that Social Workers take a new look at the practice of their profession.

5. The National Social Work Council led a national process of study, reflection and updating of the Code given in Section 2 of this Order, with the participation of academic units and social work bodies, such that a new text was obtained for the Code of Professional Ethics for Social Workers in Colombia, and this was approved at an ordinary session of the Council on Friday, January 25, 2002.

6. The text speaks of "Social Workers", and this is a generic plural which includes both genders in the profession.

IT IS AGREED THAT

Article 1. The Code of Professional Ethics of Social Workers in Colombia, approved at the ordinary sessions of the National Social Work Council of Friday, was adopted on January 25, 2002, in the terms that appear below:

CHAPTER I

GENERAL



Article 1. Social Work. In accordance with the legal regulations of this area, Social Work is understood to be the profession in the field of social and human sciences, which intervenes in processes and projects related to social and human welfare and development policies, based on the meta-criteria of democracy: the common weal, justice and liberty, in the context of professional activity as explained below:

a. The ethics and professionalism of Social Workers does credit to those who claim to practice that profession.

b. The professional Social Worker requires solid formation in ethics, epistemology, political theory, research and methodology, to explain and understand the scientific aspects of social dynamics, and so, to be able to implement and manage policy, and to promote processes of participation and organization in civil society, in the construction and consolidation of democracy.

c. Social Workers will respect and enforce respect for provisions of law that secure and promote the exercise of individual and collective human rights, or the rights of peoples, the practice of respect and for difference and ethno -cultural diversity, the conservation of the environment, territorial identity and a relationship of respect between human beings and their natural surroundings.

d. The professional performance of Social Workers requires compliance with specific, inter-sectorial functions, intervention with the individuals, families, groups, organizations and communities, all in the interests of sustainable human development, so that individuals may have access to goods and services, overcome their difficulties, satisfy their individual and collective needs in relation to the state and society, and develop their potential.

e) The principles, rules and other content of this chapter are the Code of Professional Ethics for Social Workers in Colombia.


CHAPTER II

OBJECT OF THE CODE



Article 2. Content. The Code of Ethics for Social Workers comprises principles, duties and prohibitions, standards for the practice of the profession in Colombia.

Article 3. Application. This code of ethics for social work in Colombia applies to matters referring to professional conduct within Colombia.

Paragraph: If the practice of the profession takes place in another country, Social Workers must accept and apply the code of that country.

Article 4. Mandatory application. It is a duty of social workers, whether practicing or not, and whether members of a professional body or not, and of students, to be familiar with the legal and ethical contents of this Code, and observe them.



CHAPTER III

PRINCIPLES



Article 5. Social Work. As a profession which has a commitment and responsibility to human beings and society, Social Work inculcates a duty of respect in the professional Social Worker, to place a priority on individual and collective human rights and the rights of peoples - as enshrined in the universal declaration, in the Colombian constitution, and international conventions and treaties, in all professional actions; and, to apply the principles and values founded on civil, and which consists of the minimum values and norms which the members of a modern society share by the fact of being a plurality.

Article 6. Social Workers contribute to sustainable human development, when they observe the following principles:

a. Justice. This is a framework, around which the profession makes its contribution to social justice, aiming for balance in the redistribution of goods and services, and the recognition of individuals and collective groups, in their differences and rights.

b. Respect. A multi-ethnic and multi-cultural society such as Colombia´s basically requires an understanding of differences fundamental in the construction of democracy, and in appreciating that all persons are equal in dignity, and deserve equal consideration and respect, regardless of race, age, social tradition, sexual option or origins. This will be expressed in non-discrimination, and in the establishment of relations of dialogue and equity.

c. Solidarity. Solidarity is understood to be the action in which Social Workers are engaged to a cause, supporting the satisfaction of needs or interests of society, related to peace, the development of vulnerable and depressed groups, and respect for the environment.

d. Liberty. Social Workers will be independent professionals, with their own criteria of freedom and responsibility, which will allow them to take decisions in accordance with the multifarious cultural options which are to be found in Colombian society, also respecting the autonomy and self-determination of individuals who interact in their own professional practice, to develop their potential, in terms of a better quality of life.

e. Honesty. In terms of professional practice, in which personal or group purposes are not instrumented or used contrary to the general interest or to the interest of collective development.

f. Integrality. This includes dimensions of human and social development, and encourages their articulation to processes of attention and participation.

g. Co-Responsibility (Shared Responsibility). This aspect considers a condition of the actions in welfare, human and social development, and inter-sectorial, inter-institutional and inter-disciplinary responsibility.

h. Transparency. This refers to social action which matches indicators of clarity, discernment and responsibility.

i. Confidentiality. Expressed as respect for the privacy of those who provide professional services, treating the private information obtained in professional relationship as confidential.


CHAPTER IV

DUTIES AND PROHIBITIONS



Article 7. Duties of professional Social Workers:

a. To orientate and promote processes of sustainable human development in a range of social spaces, as part of the environment of social work.

b. To play an active part in the provision and evaluation of services, programs and projects in social human and social welfare and development.

c. To take part in the formulation, development and evaluation of social policy produced by the State and private sources.

d. To undertake research and to take part in processes which help to understand, identify, explain and intervene in social realities, and transform them.

e To promote public participation in educational and institutional plans, programs and projects related to social coexistence and security, productive development, decentralization, decentralization and integral prevention of a range of social problems.

f. To manage programs of social welfare for employment, social security and occupational health.

g. To provide guidance and accompaniment in situations involving social actors and subjects, applying professional processes and methods.

h. To promote, dynamize, coordinate and manage processes of participation and organization at the various levels of public and private administration

i. To encourage processes of social action in NGOs.

j. To encourage participation in processes which make it possible to appropriate knowledge and strategy on the management and solution of conflict.

k. To promote the creation and consolidation of social support networks, at institutional level in formal terms, and community level in informal terms, to enhance and optimize group action, so that resources will be managed and coordinated with the benefit of synergy.

Article 8. Prohibitions. Social Workers may not:

a. Practice the profession of Social Worker, without accrediting their professional registration.

b. Fail to observe the terms of Law 53/1977, Decree 2083/1981, and other provisions designed to preserve morality in public administration, the terms of the Colombian Constitution, the Universal Declaration of Human Rights, and other private sector regulations which contribute to the welfare of society.

c. Discredit their profession, by denying all deprecating it.

d. Fail to be loyal to the profession, to professional colleagues, or professional bodies.

e Make use of legal measures designed to coerce or take a position in favor of or against the parties involved in a conflict; the Social Worker's actions must be that of a mediator, conciliator, or guide, except where provisions of law which regulates community justice have given the Social Worker the authority to mediate and decide in equity on conflicts in which the Social Worker is involved.

f. Support, directly or otherwise, individuals or groups, political movements or power structures which threaten human rights or the conservation of the environment, by means such as terrorism, torture, forced disappearance, or other forms of violence.

g. Make improper use of the funds of institutions, companies or social projects for entrusted to them for management or custody.


CHAPTER V

RULES FOR THE PRACTICE THE PROFESSION



Article 9. General. Only those who possess the qualifications of Social Worker, issued in accordance with Law 53/1977 and Decree 2833/1981 (Articles 2 and 5), and have obtained their registration at the National Social Work Council (Article 6 of Law 53) may practice the profession of Social Work.

Article 10. Rules related to users:

a. The Social Worker will assume responsibility for the professional relationship maintained with direct service users, in the context of acceptance and respect for autonomy contained the Constitution, as an expression of the Democratic State.

b. The Social Worker will establish professional relationships based on empathy and credibility to recognize the user as a legitimate "other".

c.. The Social Worker will appreciate the different cultures and contexts of the invention.

Article 11. Rules related to colleagues:

a. The Social Worker will recognize and respect the professional authority of colleagues, and other professionals, and will give uni-disciplinary, inter-disciplinary and trans-disciplinary work the importance required by each for comprehensive attention.

b. The Social Worker will share with colleagues and professionals from other disciplines, knowledge, experience and proposals which could help to improve the situation of the entity in which the work is done.

c. The Social Worker will refrain from making any kind of judgment or opinion which may cause any harm to the "honor" of colleagues.

d. The Social Worker will promptly report any cases of violation of the Code of Ethics to the National Social Worker Council, with supporting evidence.

Article 12. Rules related to organizational performance:

a. The Social Worker will cooperate with entities and institutions with policies, plans, programs and projects intended to encourage human and social development in the area of employment welfare.

b. The Social Worker will promote, direct or support processes of human social action in companies and other kinds of organization.

c. The Social Worker will take up the organization´s project with loyalty, commitment and critical analysis, to create the awareness of ·“social responsibility"

d . The Social Worker will adopt the instructions and procedures which the entity provides in order to optimize its services.

Article 13. Rules related to performance in teaching:

a. The Social Worker who decides to take part in the formation of Social Workers, will take training in pedagogy and in university training, and accept commitments to "continue in education"

b. The Social Worker will encourage the “integral formation” that will potentiate the professional “identity” of the student

c. The Social Worker will support the academic unit in processes of quality improvement for social work education

d. The Social Worker will distinguish between the relationship between teacher and student, and the relationship between Social Worker and user, in order to secure appropriate teacher performance.

e. The Social Worker will promote the dissemination of the regulations for the profession of Social Work and it's organizations, and the study of the Code of Ethics.; and will contribute to the strengthening of this professional activity

f The Social Worker will support and simulate processes of research, which will contribute to the theoretical and methodological frameworks of Social Work.




CHAPTER VI

DISCIPLINE, SANCTIONS, INSTANCES AND PROCEDURES



Article 14. The following are reasons for sanctions (without prejudice to the civil or criminal action that might apply):

a. Contravention of the provisions of law regulating the profession, in Law 53/1977 and Regulatory Decree 2833/1981

b. Breach of regulations or norms of this Code, and any act which law treats as being a minor offense or a criminal offense.

Article 15. The sanction referred to in Subsection a) of Article 8 of Law 53/1977, in harmony with Article 7 of Decree 2833/1981, will be imposed after study an assessment of the complaint made, and considering the nature and gravity of the beach, personal and professional background of the person responsible, and the social importance of the damage caused.

Article 16. Denunciations for breach of professional ethics may be made by individuals or corporate entities, and must be made in writing, attaching documentation in support.

Article 17. The National Social Work Council will create an Ethics Committee to study and analyze denunciations.

Article 18. The Ethics Committee will be composed of representatives of each of the national bodies of the profession, as follows:

a. A Social Worker, on behalf of the National Council for Education in Social Work, CONETS

b. A Social Worker on behalf of the National Social Worker´s Federation, FECTS

c. A Social Worker on behalf of the National Social Work Council , Law 53/1977, Decree 2833/1981.

Article 19. The appointment of Social Workers by each of these bodies will take account of the following factors:

a. The appointee must enjoy recognized personal and professional reputation.

b. The appointee must have practiced for not less than 10 years.

Article 20. The Social Workers appointed to form the Ethics Committee will be appointed for a period of three years, and may be re-elected. They will be sworn in before the National Social Work Council, Law 53/1977, Decree 2833/1981, at an ordinary or special meeting.

Article 21. Disciplinary procedure

a. The denunciation will be received and formalized at the office of the Executive Director of the National Social Work Council , Law 53/1977, Decree 2833/1981.

b. The Ethics Committee will study and analyze the case and issue an opinion to be presented in writing to the President of the National Social Work Council

c. The President of the National Social Work Council will consider the opinion to decide on the merits and the application of sanctions, and will communicate the denunciation to be professional concerned.

d. The professional and the competent authority will be informed of the sanction imposed as a result of the denunciation.

Article 22. The president of the National Social Work Council is responsible for imposing sanctions, which may be as follows:

a. Private warning. This will be delivered orally and in writing

b. Public warning. This will be delivered in the form of a motivated resolution, and the sanction will be served on the professional and published in a visible place on the premises of the National Social Work Council , and communicated to the professional bodies (CONETS, FECTS), to academic units and professional bodies in Colombia

c. Temporary withdrawal of professional registration. The resolution imposing this sanction, which are may be effective for one to five years, will be served on the professional, and communicated to the academic units cop, and the professional bodies CONETS, FECTS.

d. Cancellation of professional registration. The resolution imposing this section will be served on the professional, and be communicated to the academic units and the professional bodies CONETS, FECTS, and the National-order public and private entities.

Article 23. Temporary withdrawal and cancellation of professional registration will be related to the gravity of the offence. In the event of temporary withdrawal, the term of disqualification will be determined by the Ethics Committee.

Article 24. The professional may request revocation and before the National Social Work Council , within 10 working days of being serve notice of the sanction.

Article 25. The only recourse against the decision of the National Social Work Council is that for revocation, as provided for in regulatory decrees.

A Propósito da ordem dos Professores...

Começo por me penalizar por a minha mensagem sobre a criação de uma Ordem dos Professores não ter sido suficientemente eloquente para suscitar um diálogo polémico entre os que defendem a sua criação e aqueles outros que estão contra a sua criação como se fosse uma espécie de blasfémia. Aliás, esta apatia não pode deixar de me espantar por saber que catorze ordens profissionais estão criadas e outras tantas forcejam por aparecer à luz do dia como, por exemplo, a dos assistentes sociais.
